Privacy and Cookie Policy

Black Moon attaches great importance to the confidential, secure and transparent collection and processing of its customers’ personal data. In particular, Black Moon aims to protect its customers’ data from loss, leakage, error, unauthorised access or unlawful processing, among other things.

Through this cookie and privacy policy, Black Moon informs the client on how the personal data of clients are handled within our organisation.  Black Moon respects the privacy of its customers and adheres to the rules set by the AVG/GDPR.

1) Personal data

By communicating his personal data, the customer declares to have taken note of this GDPR and explicitly agrees with the privacy policy of Black Moon,aswell as with the processing of these data.

Personal data includes: name and address details, telephone number, e-mail address and, if applicable, billing details.

Black Moon respects the Belgian law on the protection of privacy in the processing of personal data.

The client is responsible for the accuracy of the data he provides to Black Moon.

The client is not obliged to provide personal data to Black Moon.  However, when the client does not consent to the collection and processing of his data, Black Moon is unable to provide its services.

The customer’s personal data are protected against misuse and access by unauthorised persons by means of the current usual techniques.

The personal data provided by the customer will only be used for the following purposes:

  • Creating an account
  • Processing the order
  • The administrative processing and financial administration of the order.
  • Making the address label and sending out the order 
  • Sending a digital newsletter if the customer has explicitly given permission for that
  • To comply with laws and regulations

 Our employees and third parties engaged by us are obliged to respect the confidentiality of the data provided by the customer.

The customer accepts that electronic communications and backups may serve as evidence.

A data leak will be reported to the Authority for the Protection of Personal Data if it will lead to a significant risk of serious adverse effects on the protection of personal data, or if it will have serious adverse effects on the protection of personal data. The data breach shall also be reported to the data subject(s) if it is likely to have an adverse effect on their organisation or privacy.

 

2) Access and right to rectify your data

The customer has the option and right to access their data at any time by contacting Black Moon at info@black-moon.be

The customer has the legal right to inspect and possibly correct his personal data.  Subject to proof of identity (copy of identity card), the customer can obtain written notification of his personal data free of charge at info@black-moon.be. If necessary, the customer may also request the correction of any data that is incorrect, incomplete or irrelevant.

In case of use of data for direct marketing: The customer may object, free of charge, to the use of his data for direct marketing. You can always contact Black Moon at info@black-moon.be.

 

3) Storage period

The personal data of the client are kept and processed by Black Moon as long as necessary for the aforementioned purposes or as long as required by law.

Black Moon can keep the personal data longer if there are circumstances that give rise to this.

 

4)Confidentiality and third parties

Black Moon treats the data of the client as confidential information and will not pass it on, rent or sell it to third parties, except to third parties involved in the execution of the order, namely the carrier and any intermediary party. By placing his order, the client authorises the carrier and the intermediary party to use his personal data to process the shipment.

The customer is responsible for keeping his login data confidential and for the use of his password. The password of the client is stored in an encrypted way, Black Moon has no access to this password.

Black Moon keeps online (anonymous) visitor statistics to see which pages of the website are visited and to what extent.

5) Right to restrict or delete data

The client has the right to request Black Moon to delete his personal data or limit its processing as provided by the AVG. 

Black Moon may refuse to accept this limitation or deletion of personal data when they are necessary for the performance of the agreement, to comply with a legal obligation or for a legitimate interest of Black Moon, as long as these data are necessary for the purposes for which they were collected.

 

6) Use of cookies

A cookie is a text file that is placed by a website’s server in the browser of a customer’s computer or mobile device when the customer consults a website. Cookies cannot be used to identify people, a cookie can only identify a machine.

Black Moon stores cookies when you visit the website. You can always choose to disable or refuse cookies.

The following cookies are used on the Black Moon website:

  • Analytical Cookies: These cookies are used to track visitor statistics, among other things.  This will give a better insight into the functioning of the website.  Analytical cookies have hardly any impact on privacy. Google Analytics, for example, uses analytical cookies.
  • Functional Cookies: These cookies are necessary for a website to function.  These are, for example, files that keep track of what is in your shopping basket.
  • Permanent Cookies: These are cookies that remain on your computer even after you close your browser.  You can delete permanent cookies manually via your browser settings.  
  • Temporary Cookies (or Sessional Cookies): These cookies are immediately deleted from your device after the browser is closed.  They are therefore only used during one website session and are only stored on your device for a very short time.
  • Direct Cookies (or First-party Cookies): These are cookies created and sent by the website you are browsing.  The information therefore goes to the website operator itself.
  • Indirect Cookies (or Third-party Cookies): These cookies are placed when a website contains elements from a third party, such as social media widgets, embedded software, advertisements or embedded videos.  In this case, the external party sends along cookies from its own servers.
  • Social Media Cookies: these cookies are placed by third parties such as Facebook and Instagram, when a websiteoperator chooses to integrate Facebook and/or Instagram content into their website.

 

7)Amendments

This Privacy and Cookie Policy may be amended by Black Moon.  This Privacy and Cookie Policy was last amended on 5 July 2022.
